Used Vehicles Under Louisiana — REDHIBITION's Unique Coverage

Louisiana's Lemon Law doesn't cover used vehicles — but REDHIBITION (La. Civ. Code art. 2520) provides UNIQUE civil-law rescission for hidden vice, including private-party sales.

Why used vehicles need Redhibition

§ 51:1941 defines a covered vehicle as a “new motor vehicle” — explicitly excluding used vehicles. But Louisiana’s civil-law tradition fills the gap with Redhibition.

Redhibition under La. Civ. Code art. 2520 provides:

  • Available for used vehicles — including private-party sales (UNIQUE in the US).

  • Magnuson-Moss Warranty Act — applies where factory or dealer warranty is in place. 4-year UCC SOL.
  • LUTPA (§ 51:1401) — applies to deceptive used-car practices. 1-year peremptive SOL.
  • UCC § 10:2-313 / § 10:2-314 — express and implied warranties. 4-year SOL.

”As-is” sales and Redhibition

Louisiana permits “as-is” used-vehicle sales — but bad-faith concealment of known defects still gives rise to Redhibition under art. 2545, even with an “as-is” disclaimer. This is a powerful protection.

Practical advice for used-car buyers

  • Get pre-sale inspection by independent mechanic — particularly for flood damage.
  • Check Carfax / AutoCheck / NMVTIS for prior damage AND hurricane flood markers.
  • Confirm warranty in writing.
  • Save the buyer’s guide required by FTC.
  • Document any defects immediately.
  • For hidden vice cases, consider Redhibition — direct cause of action without IDS.

Bottom line

Louisiana’s Lemon Law doesn’t cover used vehicles — but Redhibition provides uniquely powerful protection that no other US state has. For used-vehicle hidden vice cases, especially hurricane flood non-disclosure, Redhibition is the most powerful Louisiana remedy.
