Commercial Vehicles Under Louisiana Lemon Law

Commercial-vehicle coverage under Louisiana § 51:1941 — 10,000 lbs GVWR cap. Redhibition still applies to commercial vehicles.

Commercial-use vehicles face limited coverage under Louisiana’s Lemon Law (§ 51:1941). The statute excludes vehicles above 10,000 lbs GVWR and vehicles purchased for commercial-only use. But Redhibition under La. Civ. Code art. 2520 applies to commercial vehicles — providing Louisiana commercial-vehicle buyers a powerful remedy unavailable in other states.

§ 51:1941 exclusions

  • Vehicles above 10,000 lbs GVWR.
  • Vehicles purchased for commercial use (not personal/family/household).
  • Motor homes above 10,000 lbs (except chassis).

Common exclusion lines

  • Ford F-450, F-550, F-650/750 — typically above 10,000 lbs GVWR.
  • Ram 4500, 5500 — above 10K.
  • GM Silverado 4500HD, 5500HD, 6500HD — above 10K.
  • Class C / Class A motor home chassis — above 10K.
  • Cargo vans (Sprinter, ProMaster, Transit 350 HD) — varies.
  • Petrochemical fleet trucks — typically commercial-use excluded.

Redhibition for commercial vehicles — UNIQUE Louisiana

Unlike § 51:1941, Redhibition under La. Civ. Code art. 2520 applies to commercial vehicle sales:

  • Sale of any moveable triggers redhibitory warranty.
  • No “personal use” requirement.
  • No GVWR cap.
  • Bad-faith seller pays attorney fees under art. 2545.

This makes Louisiana the only state where commercial truck buyers have civil-law hidden-vice protection.

Alternative remedies for excluded vehicles

For commercial-use or >10K GVWR vehicles:

  • Magnuson-Moss Warranty Act — applies regardless of GVWR.
  • UCC § 10:2-313 / § 10:2-314 — express + implied warranties.
  • LUTPA — applies to commercial transactions (with some limitations).
  • REDHIBITION — uniquely available for Louisiana commercial vehicles.

Louisiana petrochemical / fleet market

Louisiana’s petrochemical industry creates substantial commercial-vehicle activity:

  • ExxonMobil Baton Rouge / Lake Charles.
  • Cargill Reserve Terminal.
  • Marathon Petroleum Garyville.
  • Gulf Coast refineries (Lake Charles).

Commercial-vehicle Lemon Law / Redhibition cases for these fleets are not uncommon.

Mixed-use vehicles

  • Personal predominant use — § 51:1941 may apply.
  • Commercial predominant use — § 51:1941 excluded but Redhibition applies.

Bottom line

Commercial vehicles above 10K GVWR are excluded from § 51:1941. But Redhibition uniquely covers commercial vehicles in Louisiana — providing protection unavailable in other states.
