Motorcycles Under Louisiana Lemon Law
Why motorcycles are excluded from Louisiana's Lemon Law — and how Redhibition still protects Harley-Davidson, Indian, BMW, and Ducati buyers.
Motorcycles are excluded from Louisiana’s Lemon Law (§ 51:1941), along with motor homes. The 4-attempt / 45-day OOS presumption and BBB Auto Line IDS do not apply to a defective motorcycle. But Louisiana riders are not without a remedy: Redhibition under La. Civ. Code art. 2520 applies to the sale of any thing — including motorcycles — and is often the stronger claim.
Coverage
§ 51:1941 defines “motor vehicle” so as to exclude motorcycles (and motor homes, except a personal-use motor home’s chassis and drive train). A defective motorcycle therefore cannot use the statutory Lemon Law presumption. Instead, motorcycle buyers rely on Redhibition plus Magnuson-Moss and LUTPA.
Common motorcycle defect patterns
- Engine — internal failures, cam-chain tensioner issues.
- Transmission — false neutrals, hard shifts.
- Electrical — battery drain, ECU failures.
- Cooling — overheating, fan failures.
- Brakes — ABS failures, recall-worthy issues.
- Suspension — fork seal failures.
Brand-specific patterns
- Harley-Davidson — Milwaukee 8 engine cam chain, Twin-Cam oil cooler. Strong LA market.
- Indian Motorcycle (Polaris) — Thunderstroke engine, electrical.
- BMW — Boxer engine failures.
- Ducati — Desmo valve clearance.
- Triumph — recall patterns.
Louisiana motorcycle market
- Strong Harley-Davidson market — New Orleans, Baton Rouge, rural LA.
- Year-round riding — Louisiana climate supports.
- Mardi Gras / festival riding.
Hurricane flood motorcycles
Motorcycles parked outside during hurricanes can have hidden electrical / mechanical damage — Redhibition cases.
Remedy path for motorcycles
Because the Lemon Law excludes motorcycles, build the case on Redhibition (rescission or quanti minoris price reduction for a hidden vice), with Magnuson-Moss and LUTPA as parallel federal and unfair-practice claims. Redhibition carries its own attorney-fee recovery against a manufacturer-seller presumed to know the defect.
Bottom line
Motorcycles are excluded from Louisiana’s Lemon Law, but Redhibition, Magnuson-Moss, and LUTPA give riders a real path to a refund or price reduction. Get a free case review.
