Filing a Louisiana vehicle-defect claim is structured — documented repair attempts (for Lemon Law), written notice, manufacturer IDS, then court action. For hidden vice (Redhibition), no repair attempts are required — direct court action is available.
Step 1 — Confirm eligibility
For Lemon Law:
- Vehicle covered: new, GVWR under 10,000 lbs, personal/family/household use.
- Within 1-year Rights Period.
- Repair attempts documented (4+ attempts or 30+ days OOS).
For Redhibition:
- Any vehicle (new or used, dealer or private-party).
- Hidden vice that existed at sale.
- Discovered within 1 year of discovery (bad-faith seller) or 4 years of delivery.

Step 3 — Send written notice
For Lemon Law, send notice via certified mail to the manufacturer. For LUTPA / Redhibition cases involving dealer fraud, also send notice to the dealer.

Step 4 — File BBB Auto Line (or manufacturer’s certified IDS)
If unresolved, file with the manufacturer’s certified IDS — typically BBB Auto Line. Required first under § 51:1944 if certified.
Step 5 — Court action
For cases with LUTPA / Redhibition exposure or after BBB Auto Line:
- Louisiana District Court — Orleans Parish (New Orleans), East Baton Rouge Parish, Lafayette Parish, Caddo Parish (Shreveport), etc.
- D. La. federal court — Magnuson-Moss + diversity jurisdiction (>$50K). E.D./M.D./W.D. divisions.
Court action with parallel Lemon Law + LUTPA + Redhibition + Magnuson-Moss claims maximizes recovery. File LUTPA claims within 1 year of transaction — peremptive deadline cannot be extended.
