The Process: Filing a Louisiana Lemon Law / Redhibition Claim
The step-by-step Louisiana vehicle-defect process — repair attempts, written notice, BBB Auto Line IDS, court action with LUTPA + Redhibition + Magnuson-Moss claims.
A Louisiana vehicle-defect claim can travel through several procedural paths — Lemon Law (BBB Auto Line then court), LUTPA (court), Redhibition (court), and Magnuson-Moss (court). The 1-year peremptive LUTPA SOL is unforgiving.
The five steps
- Document repair attempts — Repair orders, dates, mileage, complaint language, OOS days. Required to meet § 51:1944 thresholds.
- Send written notice — Written final-repair-opportunity notice to manufacturer.
- Manufacturer response — Manufacturer either offers refund/replacement, denies, or schedules final repair.
- BBB Auto Line / certified IDS — Required first under § 51:1944 if certified.
- Court action — Louisiana District Court or D. La. federal court with parallel LUTPA + Redhibition + Magnuson-Moss claims.

BBB Auto Line vs. court action — when to choose
| Factor | BBB Auto Line | Court Action |
|---|---|---|
| Speed | 40-60 days | 6-18 months |
| Filing fee | $0 (manufacturer pays) | Court filing fees + service |
| LUTPA treble damages | No | Yes — § 51:1409(A), only if practice continues after AG notice |
| Redhibition rescission | No | Yes — La. Civ. Code art. 2520 |
| Attorney fees | § 51:1947 still apply post-IDS | § 51:1947 + LUTPA + Redhibition + MMWA |
| Binding | On manufacturer only (if consumer accepts) | Yes |
| Discovery | None | Full |
| Best for | Clean refund/replacement cases | LUTPA / Redhibition / hidden-vice cases |
No state arbitration
Unlike CT/FL/WA/NJ/MA/GA/MN, Louisiana has no separate state-administered Lemon Law arbitration board.
Critical timing — LUTPA peremption
The 1-year LUTPA SOL is peremptive — it cannot be tolled under Louisiana civil law. This makes Louisiana’s UDAP deadline more brutal than peer states with prescriptive SOLs (which can be paused for various reasons).
File LUTPA claims promptly. Magnuson-Moss + Redhibition + UCC provide longer backstops.
