Used Vehicles Under Virginia Lemon Law

Used vehicles within the original manufacturer's warranty AND the 18-month window are covered. VCPA covers misrepresentation beyond that.

Virginia’s Lemon Law covers used vehicles in narrow circumstances — within original manufacturer warranty AND the 18-month window.

When used vehicles are covered

Full Virginia Lemon Law remedies apply, including BBB Auto Line (if mandatory) and court action with parallel VCPA.

The 18-month window runs from the original delivery date — not from when the used buyer took ownership.

CPO vehicles

No CPO-specific statute in Virginia. CPO vehicles get protection through:

Dealer-issued warranties

Governed by Magnuson-Moss, Virginia UCC, and VCPA.

”As-is” sales and the VCPA backstop

Virginia UCC allows disclaimers, but Magnuson-Moss § 2308 blocks disclaimer while a written warranty is in force. VCPA still applies to misrepresentation regardless of “as-is” language.
