Vehicle Types Covered Under Tennessee Lemon Law

How Tennessee's Lemon Law applies to used vehicles, leases, EVs (VW Chattanooga and GM Spring Hill plants!), motorcycles, RVs, and commercial vehicles.

Tennessee covers a wide range of vehicle types. EV cases are particularly interesting given the VW Chattanooga plant (Atlas, ID.4) and GM Spring Hill plant (Cadillac LYRIQ, GMC Acadia) producing vehicles right in the state.

Vehicle types covered

  • Used vehicles — Not covered by § 55-24-101; Magnuson-Moss + TCPA + UCC remain.
  • Leased vehicles — Lessees protected; refund includes lease payments + sales tax + residual.
  • Electric vehicles — Strong Tesla / Rivian + Chattanooga-made VW ID.4 + Spring Hill-made Cadillac LYRIQ.
  • Motorcycles — Explicitly covered.
  • RVs — Chassis only (motor home coaches not covered).
  • Commercial vehicles — Excluded above 10,000 lbs GVWR and commercial-only use.

Home-state manufacturer wrinkle

Three major manufacturers operate plants in Tennessee:

  1. Nissan Smyrna — largest Nissan plant in North America. Builds Altima, Maxima, Rogue, Pathfinder, Murano, Leaf, Frontier, and others.
  2. VW Chattanooga — Atlas, Atlas Cross Sport, Passat (now ID.4 EV).
  3. GM Spring Hill — Cadillac LYRIQ, XT5, XT6, GMC Acadia.

These home-state defendants are subject to Tennessee personal jurisdiction without question. Lemon Law cases against them are typically venued in Davidson County (Nashville) or M.D. Tenn.

GVWR / use restrictions

The Lemon Law (§ 55-24-101) excludes vehicles above 10,000 lbs GVWR and vehicles purchased for commercial use only. Heavy-duty pickups (Ford F-450/550, Ram 4500/5500, Silverado 4500HD/5500HD) often fall outside. Magnuson-Moss applies regardless of GVWR.
