Motorcycles Under the South Dakota Lemon Law
Whether South Dakota's lemon law covers motorcycles — they're not expressly excluded (the Sturgis question) — and the Magnuson-Moss and DTPA alternatives.
Unlike Montana and Delaware (which expressly exclude motorcycles), South Dakota’s lemon law does not expressly exclude them. Because § 32-6D-1(5) covers a “self-propelled vehicle intended primarily for use on the public highways,” a highway motorcycle may qualify — a question that matters in the home of the world’s largest motorcycle rally.
The Sturgis question
South Dakota hosts the Sturgis Motorcycle Rally, and motorcycles are a meaningful part of the state’s vehicle market. The lemon law’s coverage definition (self-propelled, primarily for highway use, personal use, under 15,000 lbs) could reach a street motorcycle — the statute’s exclusions are motor homes and 15,000-lb+ vehicles, not motorcycles. Coverage isn’t certain, so confirm eligibility for a specific motorcycle.
How a motorcycle claim would proceed
If covered, a motorcycle follows the same path:
- The defect first reported within 1 year or 12,000 miles (rights period).
- 4 attempts (+ final) or 30 calendar days out of service within 2 years / 24,000 miles. See the presumption.
- Certified-mail notice and the 7-day/14-day final cure (§ 32-6D-6).
The alternatives that always apply
- Magnuson-Moss — the federal warranty act covers motorcycles as consumer products; § 2310(d)(2) fees; 4-year runway. A reliable path whether or not the lemon law reaches the bike.
- South Dakota DTPA — actual damages for misrepresentation (no treble, no general fee provision).
- Implied warranty of merchantability (§ 57A-2-314).
Common motorcycle defects
- Engine / fuel-injection defects — stalling, hard starting (cold-start).
- Electrical / charging-system failures.
- Transmission / drivetrain defects.
- Brake-system failures — safety-critical.
- Suspension failures.
Bottom line
South Dakota’s lemon law doesn’t expressly exclude motorcycles, so a highway motorcycle may qualify (confirm coverage) — and Magnuson-Moss and the DTPA always provide a path. Get a free case review.
