Commercial Vehicles Under the South Dakota Lemon Law

How South Dakota's personal-use rule and 15,000-lb cap affect commercial vehicles — and why Magnuson-Moss and the DTPA carry the load for fleets.

The South Dakota Lemon Law covers vehicles for personal use, and excludes vehicles of 15,000 lbs GVWR or more (§ 32-6D-1(5)). So business-use vehicles and heavy trucks largely fall to Magnuson-Moss and the DTPA.

What’s covered and excluded

  • Coveredpersonal-use vehicles under 15,000 lbs (cars, SUVs, light pickups).
  • Excludedbusiness/commercial-use vehicles, vehicles 15,000 lbs GVWR or more, and motor homes.

The personal-use line and the 15,000-lb cap

South Dakota’s coverage is personal-use focused — a vehicle bought for a business or commercial use falls outside. The weight cap is 15,000 lbs, higher than the common 10,000-lb cutoff, so more heavy-duty personal-use ranch pickups stay in scope, but genuinely commercial trucks and fleets do not.

What fills the gap for commercial vehicles

  • Magnuson-Moss — federal warranty claims; § 2310(d)(2) fees (subject to the consumer-product definition).
  • South Dakota DTPA — for unfair or deceptive practices in a fleet purchase (actual damages only, no treble, no general fee provision).
  • UCC breach-of-warranty (§ 57A-2-314 / -315) — 4-year SOL.

South Dakota commercial-vehicle context

  • Ranching, agriculture, and trades run heavy trucks across the state.
  • Winter de-icer and rural roads are hard on commercial brake and electrical systems.
  • Vast distances drive high mileage and long downtime.

Bottom line

South Dakota covers personal-use vehicles under 15,000 lbs; business-use vehicles, heavier trucks, and motor homes rely on Magnuson-Moss and the DTPA. Get a free case review to assess coverage.
