Motorcycles Under Mississippi Lemon Law

Motorcycles are EXCLUDED from Mississippi's Motor Vehicle Warranty Enforcement Act. Riders rely on federal Magnuson-Moss and UCC implied warranty. Strong MS Harley-Davidson / Gulf Coast rider market.

Motorcycles are excluded from Mississippi’s Motor Vehicle Warranty Enforcement Act under § 63-17-153’s definition of “motor vehicle.” Riders cannot pursue a Lemon Law claim under § 63-17-151 et seq. — but federal Magnuson-Moss Warranty Act applies fully and UCC implied warranty of merchantability under Miss. Code § 75-2-314 also applies.

MS motorcycle market

  • Cruisin’ the Coast annual rally (Gulf Coast) — major MS motorcycle event.
  • Natchez Trace Parkway — iconic ride.
  • Mississippi River Trail — touring route.
  • Harley-Davidson dealerships in Jackson, Tupelo, Gulfport, Meridian, Hattiesburg, Oxford.
  • Indian Motorcycle, BMW Motorrad, Ducati, Triumph, Honda, Yamaha, Kawasaki, Suzuki dealers across the state.

What motorcycle owners can pursue

Federal Magnuson-Moss

15 U.S.C. § 2301 et seq. applies to “consumer products” — including motorcycles:

  • Federal cause of action.
  • Mandatory § 2310(d)(2) attorney fees.
  • 4-year UCC SOL backstop under § 75-2-725.
  • Federal venue in S.D. Miss. or N.D. Miss.

This is the primary statutory pathway for MS motorcycle defect cases. Even more critical than for cars because MS has no state-law fee fallback (the MCPA excludes plaintiff fees entirely).

UCC § 75-2-314 implied merchantability

Every dealer sale carries implied warranty. To disclaim, § 75-2-316 requires conspicuous “as-is” language.

Narrowed MCPA

For non-disclosure cases (undisclosed accident, salvage title, odometer rollback, Hurricane Katrina flood-damage non-disclosure), the narrowed § 75-24-15 actual-financial-loss recovery applies.

Express manufacturer warranty

New motorcycles carry manufacturer’s limited warranty (typically 1-2 years for street bikes, sometimes longer for touring bikes). UCC + Magnuson-Moss enforcement.

Common MS motorcycle defect patterns

  • Harley-Davidson — Twin Cam / Milwaukee-Eight engine issues, transmission whine, charging-system failures.
  • Indian — Thunderstroke engine cam-chain issues.
  • BMW Motorrad — final-drive failures (paradigm K1200/K1300 series).
  • Honda Gold Wing — generally excellent; less exposure.
  • Sport bikes — coil-pack, fuel-injector, transmission failures.
  • Ducati — Italian electronics; expensive parts.
  • Triumph — moderate reliability; intermittent fuel-system.

MS-specific dynamics

  • Hot humid summers stress motorcycle electrical components.
  • Gulf Coast salt-air corrosion (Pascagoula, Biloxi, Gulfport) accelerates corrosion on chrome/aluminum components.
  • Hurricane Katrina (2005) flood-motorcycle non-disclosure paradigm — undisclosed flooded motorcycles in MS resale market.

Strategic framework

Since AR Lemon Law doesn’t apply, the approach is federal Magnuson-Moss + UCC + (narrowed) MCPA:

  1. Document all repair attempts.
  2. Send pre-suit notice (not under § 63-17-159 which doesn’t apply, but as Magnuson-Moss good-faith pre-suit step).
  3. Run manufacturer IDS if certified (Harley-Davidson has internal process; BMW Motorrad; Honda; Yamaha).
  4. File federal Magnuson-Moss in S.D. Miss. or N.D. Miss.

Recovery comparable to Lemon Law

Federal Magnuson-Moss recovers refund + mandatory § 2310(d)(2) fees + incidental damages — comparable to MS Lemon Law new-vehicle cases.

Bottom line

MS motorcycles are excluded from the Lemon Law but fully covered by federal Magnuson-Moss with mandatory federal fee-shifting. The strong MS Gulf Coast / Natchez Trace / Mississippi River rider market supports a meaningful caseload. Plead Magnuson-Moss + UCC + narrowed MCPA in federal court.
