The Manufacturer Denied My Tennessee Lemon Law Claim — Now What?
What to do when the manufacturer denies your claim — proceed to BBB Auto Line or court action with TCPA + Magnuson-Moss.
Manufacturer denial is common and does NOT end your Tennessee Lemon Law case. Multiple paths remain — but move quickly, with two 1-year SOLs running.
Common denial reasons
- “Not a covered defect.”
- “Defect cannot be reproduced.”
- “Outside warranty / Rights Period.”
- “Owner caused / modified.”
- “Not enough repair attempts.”
Step 1 — Document the denial
- Save the denial letter / email.
- Note the denial reasons.
- Note the customer-relations case number.
- Note the date and contact person.
Step 2 — Verify your thresholds
Confirm you’ve met § 55-24-105 thresholds:
- 3 attempts on same nonconformity, OR
- 30 cumulative calendar days OOS.
Plus within the 1-year Rights Period.
Step 3 — File BBB Auto Line (if certified)
If denied by manufacturer, file with BBB Auto Line (or other manufacturer-certified IDS):
- $0 filing fee.
- Decision in 40 days.
- Binding on manufacturer if consumer accepts.
The BBB arbitrator reviews the case independently.
Step 4 — Or file court action
For cases with TCPA exposure or after rejecting BBB:
- Tennessee Circuit Court or D. Tenn. federal court.
- Parallel TCPA + Magnuson-Moss + Lemon Law claims.
- § 55-24-108 (permissive) + mandatory § 47-18-109(e)(1) + § 2310(d)(2) fees.
- TCPA treble damages exposure for manufacturer.
Step 5 — De novo court review after BBB
If BBB denies, you can file court action de novo — the BBB decision doesn’t bind you.
Step 6 — Get an attorney
For court action, attorney representation is essentially free under the triple fee-recovery basis.
Bottom line
Denial doesn’t end the case. But Tennessee’s 1-year SOLs make timing critical. File BBB Auto Line then court action quickly — the 1-year TCPA SOL is unforgiving.
