When used vehicles are covered
Original manufacturer’s warranty AND within window
Full PA Lemon Law remedies including § 1958 attorney fees apply.
CPO vehicles
No CPO-specific statute. CPO vehicles get protection through:
- Manufacturer’s CPO warranty under Magnuson-Moss.
- Dealer’s representations supporting UTPCPL misrepresentation claims.
- Original manufacturer warranty (if active).
Dealer-issued warranties
Governed by Magnuson-Moss, Pennsylvania UCC, and UTPCPL.
”As-is” sales and the UTPCPL backstop
PA UCC allows disclaimers, but Magnuson-Moss § 2308 blocks disclaimer while a written warranty is in force. UTPCPL still applies to misrepresentation.
How the refund math works
If a used vehicle qualifies for Lemon Law refund, calculation based on what you paid (not original price), collateral charges, reasonable use deduction.
What if you’re past the window?
- UTPCPL — 6 years from accrual.
- Magnuson-Moss — 4 years from delivery.
