Filing an Oregon Lemon Law Court Action

When to file in Oregon Circuit Court or D. Or. federal court with parallel UTPA + Magnuson-Moss claims.

Oregon courts (Circuit Court + D. Or. federal court) provide the venue for cases with UTPA punitive damages exposure, dealer misrepresentation, or where the manufacturer is not subject to a certified IDS (Tesla, Rivian).

When to choose court action

  • UTPA punitive damages exposure — BBB Auto Line cannot award UTPA damages.
  • Misrepresentation by dealer — UTPA claims live in court only.
  • Tesla / Rivian — not subject to BBB Auto Line.
  • Used vehicle cases — § 646A.400 doesn’t apply; UCC + UTPA + Magnuson-Moss are court-only.
  • Complex fact patterns requiring discovery.
