CPO vehicles
No CPO-specific statute. CPO vehicles get protection through:
- Manufacturer’s CPO warranty under Magnuson-Moss.
- Dealer’s representations supporting CSPA misrepresentation claims.
- Original manufacturer warranty (if active).
Dealer-issued warranties
Governed by Magnuson-Moss, Ohio UCC, and CSPA.
”As-is” sales and the CSPA backstop
Ohio UCC allows disclaimers, but Magnuson-Moss § 2308 blocks disclaimer while a written warranty is in force. CSPA still applies to misrepresentation.
What if you’re past the window?
- CSPA — 2 years from accrual.
- Magnuson-Moss — 4 years from delivery.
