Used Vehicles Under NC Lemon Law

Used vehicles within the original manufacturer's warranty AND the 24-month / 24,000-mile Rights Period are covered. UDTPA covers misrepresentation beyond that.

NC’s Lemon Law covers used vehicles in narrow circumstances — within original manufacturer warranty AND the 24-month / 24,000-mile Rights Period.

When used vehicles are covered

Original manufacturer’s warranty AND within Rights Period

Full NC Lemon Law remedies apply, including BBB Auto Line (if mandatory) and court action with parallel UDTPA.

The Rights Period runs from the original delivery date — not from when the used buyer took ownership.

CPO vehicles

No CPO-specific statute in NC. CPO vehicles get protection through:

Dealer-issued warranties

Governed by Magnuson-Moss, NC UCC, and UDTPA.

”As-is” sales and the UDTPA backstop

NC UCC allows disclaimers, but Magnuson-Moss § 2308 blocks disclaimer while a written warranty is in force. UDTPA still applies to misrepresentation regardless of “as-is” language — and § 75-16 trebles automatically.
