Attorney Fees Under Nevada Lemon Law

Nevada's triple mandatory fee-recovery basis — § 597.688 Lemon Law + § 41.600(3) DTPA + Magnuson-Moss § 2310(d)(2).

Nevada provides three independent mandatory attorney-fee bases for prevailing consumers.

The three statutes

1. § 597.688 — Lemon Law fees

§ 597.688 provides for actual damages, costs, and reasonable attorney fees (plus any warranted punitive damages) to the prevailing consumer.

  • Mandatory (Nevada courts treat as such).
  • Covers Lemon Law claims under § 597.600.

2. § 41.600(3) — DTPA fees

§ 41.600(3) provides mandatory attorney fees in DTPA actions.

  • Mandatory for prevailing DTPA plaintiffs.
  • Separate from Lemon Law fees — not duplicative.

3. § 2310(d)(2) — Magnuson-Moss fees

“If a consumer finally prevails… the court may allow… attorneys’ fees…”

  • Federal mandatory fee provision.
  • Provides D. Nev. federal court access.

Why this matters for consumers

Triple mandatory fee shifting means attorneys take cases on contingent or hybrid basis, manufacturer pays consumer’s full fees on prevailing, litigation economics favor consumer, settlement leverage is significant.

What the fee award covers

Recoverable fees typically include hours billed, costs (filing, expert witness, deposition), pre-suit work, trial preparation, and fee-petition work.
