Commercial Vehicles Under Kentucky Law (Excluded from Lemon Law)

Kentucky’s Lemon Law excludes commercial-only-use vehicles and vehicles with more than two axles — there is no GVWR (gross-vehicle-weight) cap. The more-than-two-axle exclusion, together with the commercial-only-use and farm-machinery exclusions, is what removes tandem-axle medium-duty trucks, semi-trucks, and buses from coverage. Commercial-vehicle defect claims rely on Magnuson-Moss, UCC implied warranties under Ky. Rev. Stat. § 355.2-314, and KCPA — but NOT the KY Lemon Law framework.
Why commercial vehicles are excluded
KY’s Lemon Law turns on vehicle type and use, not weight:
- Commercial-only use — vehicles not used for personal, family, or household purposes are excluded.
- More than two axles — tandem-rear-axle and multi-axle trucks are excluded by type.
- Farm machinery / farm tractors — excluded.
What’s typically excluded
- Tandem-axle / multi-axle medium- and heavy-duty trucks (more than two axles):
- Many Class 6-8 straight trucks with a tag or pusher axle.
- Ram 4500, 5500; Chevy / GMC 4500HD, 5500HD, 6500HD; Hino, Isuzu in tandem-axle configurations.
- Semi-trucks / tractors — Freightliner, Peterbilt, Kenworth, International, Mack, Volvo Trucks, Western Star, Tesla Semi (more than two axles).
- Buses — school buses, transit buses, motor coaches (commercial use and/or more than two axles).
- Any vehicle used primarily for commercial purposes — regardless of size.
What’s typically still covered under KY Lemon Law
Two-axle vehicles used primarily for personal, family, or household purposes remain covered regardless of weight (KY has no GVWR ceiling):
- Pickup trucks (two axles) — F-150, F-250, F-350 (including single-rear-axle “dually” variants, which are still two axles), Silverado 1500/2500, Ram 1500/2500, Tacoma, Tundra, Ranger, Frontier, Colorado, Maverick, Santa Cruz, Ridgeline, Gladiator.
- Vans (two axles) — Honda Odyssey, Toyota Sienna, Chrysler Pacifica, Kia Carnival, Mercedes Metris.
- SUVs (two axles) — substantially all consumer SUVs qualify (including Ford Expedition, Lincoln Navigator from KTP Louisville).
The “primarily personal use” test is fact-intensive.
Alternative frameworks for excluded commercial vehicles
Magnuson-Moss Warranty Act
- Applies to consumer products.
- Some commercial vehicles may still qualify if purchased by individuals.
- Federal-court access (E.D./W.D. Ky.).
- § 2310(d)(2) fees.
UCC implied warranty of merchantability
- Applies to all merchant sales of goods.
- “AS IS” disclaimers possible but limited by Magnuson-Moss for vehicles with written warranties.
KCPA
- Applies to dealer misrepresentation regardless of vehicle classification.
- Punitive damages under § 367.220(1) — particularly important for misrepresentation about commercial-truck history, undisclosed prior damage.
Heavy-duty commercial warranty frameworks
- Commercial trucks have extended warranty programs.
- Dealer service contracts and fleet maintenance programs common.
- Engine manufacturer warranties (Cummins, Detroit Diesel, PACCAR MX) separate from chassis warranties.
Ford KTP Louisville heavy-duty exposure
Ford KTP Louisville produces:
- F-250, F-350, F-450, F-550 pickups — these are two-axle vehicles, so they are not excluded by the more-than-two-axle rule. A personal/family-use Super Duty pickup is Lemon Law eligible regardless of its weight (KY has no GVWR cap); the exclusion bites only when the vehicle is used primarily for commercial purposes.
For Super Duty pickups in primarily personal use, the home-state KTP Louisville defendant relationship applies — strong jurisdictional and discovery advantages.
Two-axle pickups used for work
Many KY F-150s, F-250s, Silverado 1500/2500s, Ram 1500/2500s, and similar two-axle pickups are used for combined personal/work purposes. Because there is no weight cap, the eligibility analysis turns on use, not GVWR:
- Primary purpose (personal/family vs. commercial-only).
- Title classification.
- Insurance classification.
- Tax treatment.
Two-axle pickups used primarily for personal/family transportation, even with occasional work use, generally qualify.
Documentation strategy for commercial vehicles
For commercial vehicle defect claims in KY:
- Verify the vehicle’s axle count — two axles (covered) vs. more than two (excluded).
- Verify the vehicle’s actual use pattern — personal vs. commercial-only.
- Identify the applicable warranty framework.
- Magnuson-Moss federal-court analysis.
- KCPA factual analysis if dealer misrepresentation present — punitive damages potential.
Bottom line
KY Lemon Law excludes vehicles with more than two axles and commercial-only-use vehicles — there is no GVWR cap. Two-axle pickups (including Super Duty), vans, and SUVs used substantially for personal/family transportation remain covered regardless of weight.
