Vehicle Types Covered by Iowa Lemon Law

Which vehicles IA's Lemon Law covers — used, leased, EV, motorcycles (Indian Motorcycle Spirit Lake IA home-state), RVs (Winnebago Forest City IA home-state but mostly Lemon Law-excluded), commercial.

Iowa’s Lemon Law (§ 322G) covers new motor vehicles purchased or leased in Iowa for personal, family, or household use, under 15,000 lbs GVWR (slightly higher threshold than the typical 10,000 lbs in peer states), excluding motor home living facilities. Lessees are covered. There is no separate Used Car Lemon Law in Iowa — used buyers rely on Magnuson-Moss, UCC implied warranties, and § 714H Consumer Frauds Act.

What’s covered under IA Lemon Law

§ 322G.2 covers:

  • New motor vehicles purchased in Iowa.
  • Personal, family, or household use.
  • Lessees.
  • Up to 15,000 lbs GVWR — slightly higher threshold than typical 10K (broader coverage for medium-duty pickup users).

What’s excluded

  • Vehicles 15,000+ lbs GVWR — heavy commercial trucks excluded (but IA’s threshold is broader than most states).
  • Used vehicles — no separate IA Used Car Lemon Law.
  • Motor home living facilities (chassis may still be covered).
  • Commercial-only use vehicles.

Topics in this section

  • Used vehicles — Magnuson-Moss, UCC implied warranty under § 554.2314, § 714H Consumer Frauds Act with treble damages potential.
  • Leased vehicles — Lessee rights under § 322G.
  • Electric vehicles — Tesla, Mustang Mach-E, Hyundai Ioniq, Kia EV6, Rivian. Cold-weather range loss distinctive IA case pattern.
  • Motorcycles — Motorcycles covered as motor vehicles. Indian Motorcycle Spirit Lake IA — home-state OEM for Indian motorcycles (Polaris owns Indian; Spirit Lake is the production facility).
  • RVsWinnebago Forest City IA — home-state OEM for RV cases (though motor home living facilities Lemon Law-excluded). Class B chassis under 15K may be covered.
  • Commercial vehicles — 15,000+ lbs GVWR excluded. Magnuson-Moss and UCC available.

Why used-vehicle coverage matters in IA

IA has no separate Used Car Lemon Law. Used buyers rely on:

  • Federal Magnuson-Moss Warranty Act for any remaining manufacturer warranty or dealer-provided written warranty.
  • UCC implied warranty of merchantability under Iowa Code § 554.2314 — disclaimable by “AS IS” sales (subject to Magnuson-Moss limitation when written warranty exists).
  • § 714H Consumer Frauds Act for dealer misrepresentation — with TREBLE DAMAGES for willful/wanton conduct under § 714H.5(2) and MANDATORY § 714H.5(3) attorney fees.

Flood-vehicle and tornado-damage non-disclosure paradigm

Iowa periodically experiences:

  • Mississippi River flooding (eastern IA — Davenport, Burlington, Dubuque, Clinton).
  • Missouri River flooding (western IA — Council Bluffs, Sioux City).
  • Cedar River flooding (Cedar Rapids — 2008 historic flood).
  • Tornado events (particularly southern and central IA).

Flood and tornado-damaged vehicles can enter the resale market through title washing, cosmetic repair, direct non-disclosure. This is paradigm § 714H territory:

  • Actual damages (diminished vehicle value).
  • Treble damages for willful/wanton conduct under § 714H.5(2) (heightened proof standard).
  • Mandatory § 714H.5(3) attorney fees.
  • 2-year SOL with “whichever later” discovery rule under § 714H.5(4) — consumer-favorable for active concealment cases.

The “whichever later” SOL trigger is particularly important for active-concealment cases where discovery of the deception is delayed.

Indian Motorcycle Spirit Lake IA — home-state OEM

Polaris Industries (HQ in Medina MN; see Minnesota Polaris/Indian coverage) operates the Indian Motorcycle production facility in Spirit Lake IA. For Indian motorcycle cases in IA, the home-state OEM relationship provides:

  • N.D. Iowa Sioux City Division federal venue (Spirit Lake is in Dickinson County, northwest IA).
  • Personal jurisdiction uncontested for Indian Motorcycle production cases.
  • Discovery access to Spirit Lake engineering and quality records.

This is IA’s only home-state operating consumer-vehicle OEM. Indian Motorcycle models include:

  • Indian Scout — cruiser.
  • Indian Chief — touring cruiser.
  • Indian Challenger — touring.
  • Indian Roadmaster — full-dress touring.
  • Indian FTR — flat-tracker street.

See Iowa motorcycle coverage for the manufacturer-defect framework.

Winnebago Forest City IA — home-state OEM (RV)

Winnebago Industries is headquartered and operates manufacturing in Forest City IA. Winnebago produces:

  • Class A motorhomes (Adventurer, Forza, Horizon, Vista, Sunstar, Tour, Journey).
  • Class B campervans (Travato, Solis, Era, Revel).
  • Class C motorhomes (View, Navion, Minnie Winnie, Spirit, Itasca).
  • Travel trailers and 5th wheels.

The motor home living facilities are typically Lemon Law-excluded under § 322G. Only the chassis of Winnebago motor homes under 15K GVWR may be Lemon Law eligible — though most Winnebago motorhomes use Ford / Mercedes / Chevy chassis exceeding 15K GVWR (commercial / heavy-duty).

For Winnebago motor home defects involving the coach portion, Magnuson-Moss, UCC implied warranties, and § 714H Consumer Frauds Act apply. Forest City IA home-state status creates:

  • N.D. Iowa Central Division (Fort Dodge) or N.D. Iowa Eastern Division (Cedar Rapids) federal venue (Forest City is in Winnebago County).
  • Personal jurisdiction uncontested for Winnebago.
  • Discovery access to Forest City engineering and quality records.
