Vehicle Types Covered by Georgia Lemon Law

How Georgia's Lemon Law applies to used cars, leases, EVs, motorcycles, RVs, and commercial vehicles.

Georgia’s Lemon Law (O.C.G.A. § 10-1-780 et seq.) covers new motor vehicles up to 10,000 lbs GVWR sold or leased in Georgia for personal, family, or household use.

What’s distinctive about Georgia

Georgia’s Lemon Law covers the chassis side of motor homes but not the coach side, and excludes motorcycles from primary coverage. For excluded vehicles, FBPA and Magnuson-Moss provide alternative civil-court remedies.

How to know if your vehicle is covered

For most Georgia consumers, the answer is yes within the 24-month / 24,000-mile Rights Period. Exceptions:

  • Vehicles past the Rights Period (FBPA + Magnuson-Moss only).
  • Motorcycles (FBPA only).
  • Motor home coach side (chassis covered).
  • Vehicles over 10,000 lbs GVWR.
  • Primarily commercial use.

The “consumer” definition

O.C.G.A. § 10-1-782(3) defines “consumer” to include:

  • The original purchaser of the vehicle.
  • Any subsequent transferee during the duration of the manufacturer’s warranty.
  • Any person entitled by the warranty to enforce its obligations.

This means leases and warranty assumptions both qualify.
