Engine Defects in Georgia Lemon Law Cases

Engine defects qualify for Georgia Lemon Law refund under O.C.G.A. § 10-1-782.

Engine defects routinely satisfy Georgia’s substantial-impairment test under § 10-1-782(11), and serious engine defects can trigger the single-attempt rule under § 10-1-784(b).

Common engine defect categories

Intermittent stalling

Safety-critical — typically qualifies as a serious safety defect under § 10-1-782(13), triggering the single-attempt rule. Strong FBPA exposure.

Misfires

Rough idle, hesitation under load.

Excessive oil consumption

Common in Subaru FB-series, Honda 1.5L turbo, BMW N20. See Subaru and Honda.

Head-gasket failures

Common in Subaru EJ-series and Hyundai/Kia engines.

Theta II engine failures (Hyundai/Kia)

Especially common in Georgia given Kia’s West Point assembly and Hyundai’s Metaplant in Bryan County. See Hyundai and Kia.

Timing-chain stretch / failure

BMW N20, Audi 2.0T, Ford EcoBoost.

Engine fires

Per O.C.G.A. § 10-1-782(13), risk of fire or explosion makes this a per-se serious safety defect — single attempt suffices.

FBPA willfulness exposure

TSBs and recalls support FBPA “intentional” violation and exemplary damages.

What you should do

  1. Pull every repair order.
  2. Document oil-consumption test results.
  3. Save TSBs and recall notices.
  4. Send certified-mail notice to manufacturer.
