Electric Vehicles Under Connecticut Lemon Law

How Connecticut Lemon Law applies to EVs — Tesla, Rivian, Lucid, Subaru Solterra, Hyundai/Kia, Ford Mach-E, GM Bolt.

Connecticut has a growing EV market — Tesla, Subaru Solterra, Hyundai Ioniq 5, Kia EV6, Rivian, Lucid, Ford Mach-E, GM Bolt. EVs are fully covered by Connecticut’s Lemon Law (§ 42-179) and present distinctive defect patterns.

EVs covered by § 42-179

All new passenger EVs under 10,000 lbs GVWR are covered:

  • Tesla Model S, Model X, Model 3, Model Y, Cybertruck.
  • Rivian R1T, R1S.
  • Lucid Air.
  • Subaru Solterra.
  • Hyundai Ioniq 5, Ioniq 6, Kona EV.
  • Kia EV6, EV9, Niro EV.
  • Ford Mustang Mach-E, F-150 Lightning.
  • GM Chevy Bolt EV, Bolt EUV, Equinox EV, Silverado EV, Cadillac LYRIQ.
  • VW Group ID.4, Audi e-tron, Audi Q4, Porsche Taycan.
  • Mercedes-Benz EQS, EQE, EQB.
  • BMW i4, iX, i7, iX3.
  • Polestar 2, 3.
  • Nissan Leaf, Ariya.

EV-specific qualifying defects

See our EV-specific defects article for the full list. Key categories:

  • Battery degradation beyond manufacturer’s degradation curve.
  • Range loss — particularly cold-weather range loss exceeding typical 30%.
  • Charging failures — won’t accept, slow rate, error codes.
  • MCU / infotainment — Tesla MCU2 eMMC.
  • OTA-induced failures — Tesla, Mach-E, others.
  • Door / handle failures — Tesla, Rivian.

Connecticut EV climate factor

Connecticut’s cold winters (sub-20°F regular) create range-loss patterns:

  • 30-40% range loss in cold weather is typical.
  • >40% suggests battery thermal-management or capacity defect.
  • Heat-pump performance in cold (Model Y, Ioniq 5, others) varies by manufacturer.

Tesla direct-service-only model

Tesla does not have franchised dealers — service is direct from Tesla. Connecticut Tesla service centers:

  • Milford (primary CT center).
  • Mt. Kisco, NY (closest to Fairfield County / lower CT).
  • Mobile Service vehicles for in-driveway repairs.

Repair-order issuance: Tesla service requests in the Tesla app generate repair invoices that serve as Lemon Law repair orders.

Rivian / Lucid service

  • Rivian — Connecticut service is via mobile service + Service Centers in nearby states. R1T/R1S customers in CT may travel.
  • Lucid — limited Connecticut service; East Coast service via Tysons Corner VA and Manhasset NY.

Why EV Lemon Law cases are strong in Connecticut

  1. Battery + range complaints are easy to document with vehicle telematics.
  2. Software updates create a paper trail of attempted fixes.
  3. Tesla direct-service model = manufacturer is also the service provider, simplifying Lemon Law defendant identification.
  4. Discretionary § 42-180 fees (CUTPA § 42-110g(d) is the reliable hook) and CUTPA punitives create strong settlement leverage.

Bottom line

EVs are fully covered under Connecticut Lemon Law. Battery degradation, range loss, charging failures, and software-induced issues all qualify when they substantially impair use, value, or safety. The cold-weather range issue is uniquely strong evidence in Connecticut cases.
