Magnuson-Moss Warranty Act
15 U.S.C. § 2301 et seq. applies to “consumer products,” which expressly includes motorcycles. The federal claim provides:
- Federal cause of action.
- Mandatory § 2310(d)(2) attorney fees on prevailing.
- 4-year UCC SOL backstop under Ark. Code § 4-2-725.
- Federal venue in E.D. Ark. or W.D. Ark.
This is the primary statutory pathway for AR motorcycle defect cases.
UCC § 4-2-314 implied warranty of merchantability
Every sale by a “merchant” (dealer) carries an implied warranty that the motorcycle is fit for the ordinary purpose of motorcycle operation. To disclaim, the dealer must use conspicuous “as-is” language under § 4-2-316.
Post-Act 986 ADTPA
For non-disclosure cases (undisclosed accident history, salvage title, odometer rollback, undisclosed manufacturer recall non-compliance), the narrowed ADTPA actual-financial-loss recovery applies.
Express manufacturer warranty
Most new motorcycles carry manufacturer’s limited warranty (typically 1-2 years for street bikes, sometimes longer for touring bikes). The express warranty is a contract claim under UCC + Magnuson-Moss.
Common AR motorcycle defect patterns
- Harley-Davidson — Twin Cam / Milwaukee-Eight engine issues, transmission whine, charging-system failures (paradigm: cam-chain tensioner failures on certain Twin Cam years).
- Indian — Thunderstroke engine cam-chain issues (less common than Harley).
- BMW Motorrad — final-drive failures (paradigm K1200/K1300 series; resolved in later years), shaft-drive issues.
- Honda Gold Wing — modern Gold Wing reliability is generally excellent; less Lemon Law exposure.

Strategic framework for AR motorcycle cases

Common AR ADTPA paradigms for used motorcycles:
- Undisclosed accident damage — frame bend, fork damage, undisclosed laydown.
- Salvage title non-disclosure.
- Stolen-and-recovered title non-disclosure.
- Mileage rollback (less common on motorcycles given odometer mechanism, but possible on digital-display bikes).
Bottom line
AR motorcycles are excluded from the Lemon Law but fully covered by Magnuson-Moss with mandatory federal fee-shifting.
