The statutes behind an Arizona lemon-law claim — A.R.S. § 44-1261 Lemon Law, the Arizona Consumer Fraud Act (§ 44-1521), Magnuson-Moss, and timing rules.

Arizona’s consumer-protection framework for defective vehicles draws from three statutes plus federal warranty law. Unlike most peer states, neither the Lemon Law nor the CFA has mandatory attorney-fee provisions — making Magnuson-Moss the load-bearing fee engine.

The three pillars

  1. Arizona Lemon Law — A.R.S. § 44-1261 et seq. Refund or replacement; discretionary attorney fees under § 44-1265(C). 2-year / 24,000-mile Rights Period.
  2. Arizona Consumer Fraud Act (CFA) — A.R.S. § 44-1521 et seq. Civil court; actual damages; punitive damages on intent / knowing misrepresentation; NO statutory attorney-fee provision (general § 12-341.01 contract-fee statute may apply discretionarily); 1-year limitations period under A.R.S. § 12-541(5) — among the shortest UDAP SOLs in the country.

Why three statutes instead of one

Arizona’s Lemon Law on its own has only discretionary attorney fees under § 44-1265(C) — and Arizona’s CFA has no statutory fees provision at all. The CFA adds:

Magnuson-Moss adds federal-court access (D. Ariz. — Phoenix, Tucson, Flagstaff), § 2310(d)(2) federal attorney fees (the load-bearing fee engine in Arizona), and a 4-year limitations runway.

How they interact procedurally

Arizona consumers must navigate:

  1. Manufacturer-required informal dispute settlement procedure (if one is certified under § 44-1265) — typically BBB Auto Line. Mandatory if certified.
  2. Court action — Arizona Superior Court or federal court (D. Ariz.) under Magnuson-Moss concurrent jurisdiction.

CFA and Magnuson-Moss claims live in court only, not in BBB Auto Line. The 1-year CFA SOL creates pressure to file CFA claims promptly — long delays narrow the CFA option even when Lemon Law and Magnuson-Moss remain available.
