About

Kimmel & Silverman PC is a New York-based Lemon Law firm serving drivers in Buffalo and Western New York since 1991. Operating from their Buffalo office, the firm represents consumers throughout Erie, Niagara, Genesee, Wyoming, Cattaraugus, and Chautauqua counties, as well as neighboring areas and the entire state of New York.

The firm handles claims under both the New York Lemon Law and the Federal Magnuson-Moss Warranty Act. Both statutes include fee-shifting provisions, meaning that if the firm succeeds, the manufacturer must pay all attorney fees and court costs in addition to any compensation awarded to the client. Notably, Kimmel & Silverman charges clients no out-of-pocket legal fees regardless of case outcome—a commitment that extends to those with used vehicles and claims falling outside traditional lemon law parameters.

Over more than three decades, Kimmel & Silverman has resolved more than 185,000 cases and established itself as the oldest, largest, and most successful Lemon Law firm in New York. The firm has secured more vehicle repurchases, replacements, and monetary settlements than any other state lemon law firm.

New York's Lemon Law protects purchasers, lessees, and registrants of new vehicles, motorcycles, and motorhomes for the first 18 months or 24,000 miles, whichever comes first. A vehicle qualifies if it has undergone four or more repair attempts for the same substantial defect within that period, or has been out of service for 30 cumulative days for repairs related to any defect. The defect must substantially impair the vehicle's value, use, or safety. Common issues include check engine lights, water leaks, vibration problems, locking failures, infotainment system malfunctions, and transmission troubles.

When a vehicle qualifies, clients may pursue complete repurchase (with a mileage deduction beyond 12,000 miles), a replacement vehicle applied toward the manufacturer's suggested retail price, or cash compensation while retaining the vehicle. In repurchase cases involving leased vehicles, clients may recover a significant percentage of their lease payments. Settlements do not result in a branded title, do not void the warranty, and do not require disclosure at resale or trade-in.

Drivers with used vehicles purchased under a manufacturer's warranty—or those whose situations fall outside New York Lemon Law coverage—may still pursue significant compensation for diminished vehicle value under state and federal law. Kimmel & Silverman's work has received national media attention. For a free consultation, drivers in Buffalo and Western New York can reach the firm at 1-800-LEMON-LAW (1-800-536-6652).
